At BlynQ, we believe your business data belongs to you. Our platform is built to help your business grow with AI, not to exploit your information. This Privacy Policy explains what we collect, why, and how you stay in control.

This Privacy Policy describes our practices with respect to personal data that we collect from or about you when you use the BlynQ.ai website, platform, AI agents, workflows, connected tools, software, content, features and services (collectively, "Services").

By creating an account, using BlynQ, connecting a third party tool, uploading content, or subscribing to a plan, you agree to this Privacy Policy. If you are using BlynQ on behalf of a business or organisation, you confirm that you have authority to accept this Privacy Policy on its behalf.

This Privacy Policy should be read together with our Terms of Service and any plan, order form, enterprise agreement, data processing agreement, or other written agreement we enter into with you.

This Privacy Policy does not apply to content that we process on behalf of enterprise customers under a separate data processing agreement. Our use of that data is governed by the applicable customer agreement.

We collect personal data relating to you ("Personal Data") in the following ways:

Personal Data You Provide

We collect Personal Data when you create an account, use our Services, or communicate with us, including:

  • Account Information: When you create an account, we collect your name, email address, contact information, account credentials, payment information, transaction history, business name, and onboarding answers such as your industry, team size, and business goals.
  • User Content: We collect data that you provide as input to our Services, including prompts, instructions, uploaded files, documents, PDFs, images, screenshots, spreadsheets, emails, calendar data, customer records, business data, and any other content you submit or make available through BlynQ (collectively, "Content").
  • Connected Tool Data: When you connect third party tools such as email, calendar, CRM, accounting, ecommerce, messaging, storage, analytics, or project management systems, we collect data from those tools according to the permissions you grant and the settings you configure. This may include emails, contacts, calendar events, invoices, customer records, files, messages, and other business data.
  • Communication Information: If you communicate with us via email, chat, support tickets, social media, or other channels, we collect your name, contact information, and the contents of those communications.
  • Other Information You Provide: We collect other information you provide to us, such as when you participate in surveys, events, beta programmes, or when you provide information to verify your identity or business.

Personal Data We Receive From Your Use of the Services

When you visit, use, or interact with the Services, we automatically receive the following information:

  • Log Data: Your Internet Protocol (IP) address, browser type and settings, the date and time of your request, referring URL, and how you interact with our Services.
  • Usage Data: Information about your activity across the Services, such as the agents and features you use, tasks you submit, workflows you create or trigger, the actions you take, your time zone, country, and the dates and times of access.
  • Device Information: The name, operating system, device identifiers, and browser of the device you use to access the Services.
  • Location Information: We determine the general area from which your device accesses our Services based on your IP address. We use this for security purposes, such as detecting unusual login activity, and to improve your experience.

Information We Receive From Other Sources

We may receive information from third party sources, such as trusted security and safety partners to protect against fraud, abuse, and other threats to our Services, and from marketing vendors who provide us with information about potential customers.

2. How We Use Personal Data

We use Personal Data for the following purposes:

  • To provide, analyse, and maintain our Services, including powering your AI agents, processing tasks, executing workflows, and syncing connected tools.
  • To improve and develop our Services and conduct research, such as developing new agents, features, and capabilities.
  • To personalise and customise your experience, including configuring your AI agents based on your business context, preferences, and onboarding answers.
  • To communicate with you, including responding to support requests, sending service notifications, and providing information about updates, features, or events.
  • To process payments, manage subscriptions, and administer your account.
  • To prevent fraud, illegal activity, or misuse of our Services, and to protect the security of our systems and Services.
  • To comply with legal obligations and to protect the rights, privacy, safety, or property of our users, BlynQ, or third parties.

We may also aggregate or de-identify Personal Data so that it no longer identifies you and use this information to analyse how our Services are used, to improve and add features, and to conduct research. We will maintain and use de-identified information in de-identified form and not attempt to re-identify it, unless required by law.

3. Data Sovereignty and AI Model Training

Your business data is yours. BlynQ creates isolated data environments for each customer. We do not use your proprietary business data, client lists, brand voice configurations, workflows, or agent instructions to train or improve our global AI models unless you have explicitly opted in.

BlynQ uses third party AI model providers (such as OpenAI, Anthropic, Google, and others) to power AI agent capabilities. When your Content is sent to a third party AI model provider for processing, it is transmitted securely and used only to generate a response for you. We select providers who commit to not using customer inputs for training their models, but you should review the relevant provider's terms for full details.

4. Disclosure of Personal Data

We disclose your Personal Data in the following circumstances:

  • Vendors and Service Providers: We disclose Personal Data to vendors and service providers who assist us in operating and maintaining our Services, including hosting providers, cloud infrastructure providers, payment processors, customer support providers, email delivery services, analytics providers, and security services. These parties access, process, or store Personal Data only as necessary to perform their duties to us and based on our instructions.
  • AI Model Providers: To power the AI agent capabilities of our Services, we transmit Content to third party AI model providers. These providers process the Content to generate outputs and responses. We select providers who are contractually committed to handling data securely and in accordance with applicable law.
  • Connected Third Party Tools: When you connect a third party tool to BlynQ, data may be exchanged between BlynQ and that tool according to the permissions you grant. The third party tool's own terms and privacy policy govern its use of your data.
  • Business Transfers: If BlynQ is involved in a merger, acquisition, reorganisation, bankruptcy, or sale of assets (a "Transaction"), your Personal Data may be disclosed during due diligence and transferred to a successor or affiliate as part of that Transaction.
  • Government Authorities or Other Third Parties: We may disclose Personal Data to government authorities or other third parties if required by law, if we believe disclosure is necessary to comply with a legal obligation, to protect and defend our rights or property, to detect or prevent fraud, to protect the safety and security of our Services or users, or to protect against legal liability.
  • Affiliates: We may disclose Personal Data to our affiliates, meaning entities that control, are controlled by, or are under common control with BlynQ. Our affiliates use this data in a manner consistent with this Privacy Policy.
  • Business Account Administrators: If you join a BlynQ team or enterprise account, the administrators of that account may be able to access and manage your account, including viewing your Content, usage, and connected tools.

We may also aggregate or de-identify Personal Data so that it no longer identifies you and share it with third parties for the purposes described above, such as to improve our Services.

5. Retention

We retain your Personal Data for only as long as necessary to provide our Services to you, or for other legitimate business purposes such as resolving disputes, maintaining security, and complying with our legal obligations. How long we retain Personal Data depends on the type of data, how we use it, and in many cases your settings:

  • Information we retain until you delete it: Some of our Services allow you to delete Personal Data stored in your account, such as specific task histories, agent configurations, uploaded files, connected tool data, or your entire account. Once you choose to delete Personal Data, we will remove it from our active systems within 30 days unless we need to retain it for longer as described below.
  • Information we delete automatically: Certain temporary processing data, such as intermediate AI model outputs and transient workflow data, may be deleted automatically after processing is complete.
  • Information we retain for longer for legitimate reasons: In some cases, we need to retain Personal Data for longer even after you delete it, for example because we are legally required to, to address fraud and abuse, for security reasons, or for financial record-keeping purposes. For instance, if your account is terminated for a policy violation, we may retain relevant data to protect our Services. If we receive a lawful subpoena, we may retain data for the duration of the legal obligation. Payment and transaction records may be retained for accounting and regulatory compliance purposes.

In determining retention periods, we consider factors such as our purpose for processing, the nature and sensitivity of the data, the potential risk of harm from unauthorised use or disclosure, and any applicable legal requirements.

Our Services provide you with controls over your Personal Data and how it is used and retained. You can manage these settings through your account dashboard. These include:

  • You can view and manage which third party tools are connected to your account, and revoke access at any time.
  • You can delete specific task histories, uploaded files, agent configurations, or your entire account.
  • You can export your data, including task histories, uploaded content, and account information.
  • You can manage notification and communication preferences.
  • You can manage cookie preferences where applicable.
  • You can unsubscribe from marketing communications using the choices provided in those communications.

7. Your Rights

Depending on where you live, you may have certain statutory rights in relation to your Personal Data. These may include the right to:

  • Access your Personal Data and information relating to how it is processed.
  • Rectify or update your Personal Data.
  • Delete your Personal Data from our records.

A note about accuracy: BlynQ uses AI models that generate outputs by predicting the most likely response to your input. In some cases, outputs may not be fully accurate. You should not rely on the factual accuracy of AI generated outputs without review. If you notice that a BlynQ output contains factually inaccurate information about you and you would like to request a correction or removal, please contact us using the details below.

8. Third Party AI Models and Services

BlynQ uses third party AI models, infrastructure providers, APIs, software, data processors, and connected tools to provide the Services. These may include providers such as OpenAI, Anthropic, Google, Microsoft, hosting providers, payment processors, and other technology partners.

Third party services are subject to their own terms, policies, privacy rules, data handling rules, and usage restrictions. We select providers who meet our security and privacy requirements, but we encourage you to review the privacy practices of any third party tools you choose to connect to BlynQ.

We may add, remove, replace, or change third party providers where reasonably necessary to operate, improve, secure, or maintain the Services.

9. Encryption and Security

We implement commercially reasonable technical, administrative, and organisational measures designed to protect Personal Data from loss, misuse, and unauthorised access, disclosure, alteration, or destruction. These measures include:

  • Encryption of data in transit and at rest using industry standard protocols (such as TLS and AES-256).
  • Access controls and authentication mechanisms to restrict access to Personal Data to authorised personnel.
  • Regular security assessments, monitoring, and testing of our systems.

However, no internet or email transmission is ever fully secure or error free. We are not responsible for circumvention of any privacy settings or security measures contained on the Services or third party platforms.

10. Children

Our Services are not directed to, or intended for, children under 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect Personal Data from children under 13. We will investigate any notification and, if appropriate, delete the Personal Data from our systems.

BlynQ processes your Personal Data on servers located in various jurisdictions, including processing and storing your Personal Data in Australia, and in countries or territories where our affiliates, partners, vendors, service providers, or AI model providers are located.

While data protection law varies by country, we apply the protections described in this Privacy Policy to your Personal Data regardless of where it is processed. Where required by law, we transfer data only pursuant to legally valid transfer mechanisms, such as standard contractual clauses or other approved frameworks.

Australian Privacy Act

We do not sell Personal Data, share Personal Data for cross-contextual behavioural advertising, or process sensitive Personal Data for the purposes of inferring characteristics about a consumer.

We may update this Privacy Policy from time to time to reflect changes in our practices, the Services, applicable law, or for other operational, legal, or regulatory reasons. If you continue using BlynQ after the updated Privacy Policy takes effect, you agree to the updated Privacy Policy. If you do not agree, you must stop using the Services.
